ビットコインなどの暗号資産を投資対象とする人が増える中、暗号資産を「金融商品」として位置づける金融商品取引法の改正案が15日に開かれた参議院本会議で可決・成立しました。

暗号資産は国内で利用者が年々増え、口座の数はのべで1400万を超えていますが、これまで法律上は「資金決済の手段」という位置づけでした。

改正金融商品取引法では暗号資産を「金融商品」として位置づけ、インサイダー規制の対象とするほか、暗号資産を新たに作って資金を調達する発行者については、資金の使いみちなどの情報提供を義務づけます。

また無登録で暗号資産を販売した業者への罰則も強化し、拘禁刑を「3年以下」から「10年以下」に、罰金を「300万円以下」から「1000万円以下」にそれぞれ引き上げます。

さらに、不正アクセスによる流出に備え、暗号資産の取り引き業者には顧客への補償にあてるための準備金を積み立てるよう求めるとしています。
