証券取引等監視委員会がインサイダー取引にあたるとして課徴金の支払いを命じるよう求めた勧告について、金融庁は法令違反は認められないとする異例の決定を出しました。

証券取引等監視委員会は、LINEグループと宅配サービス大手「出前館」が2020年に発表した資本業務提携をめぐり、情報の公表前にインサイダー取引をしたとして、2025年、LINEの海外の子会社に勤務していた外国籍の元従業員に1400万円あまりの課徴金の納付を命じるよう金融庁に勧告しました。

勧告をめぐっては、元従業員が業務提携に関する情報を社内の関係者から伝達された時期が発表前だったかなどに争いがあり、金融庁は審判を開いてきました。

審判で元従業員は、「情報を知ったのは発表前ではなく、自身の知識や相場観で株式の取引をしたにすぎない」などと主張していました。

これについて金融庁は、当時の関係者の説明などから、監視委員会が主張する時期までに元従業員が情報の伝達を受けたとはいえないと判断し、9日、法令違反は認められないとする異例の決定を出しました。
