日本の国旗を損壊する行為を罰する法律が、13日、施行されました。著しく不快感や嫌悪感を催させる方法で国旗を公然と損壊する行為などに対し罰則が科されることになり、法務省は「法律の趣旨や対象となる行為などを周知し、適正な運用に努めていきたい」としています。

13日施行された日本の国旗を損壊する行為を罰する法律は、自民・維新両党と、国民民主党、参政党の4党が共同で提出し、先月、国会で成立したものです。

法律では、対象となる国旗を「国旗として用いられていると社会通念上、認められる有体物」と定義し、著しく不快感や嫌悪感を催させる方法で、国旗を公然と損壊、除去、汚損する行為に対して2年以下の拘禁刑か20万円以下の罰金を科すとしています。

一方で、罪に該当するかどうかは、行為や周囲の状況などを客観的に勘案して判断するとしているほか、表現の自由など、憲法が保障する国民の自由と権利を不当に侵害しないよう留意しなければならないとしています。

国会での審議では「罰則の対象があいまいだ」という指摘も相次ぎ、法律を所管する法務省は「法律の趣旨や対象となる行為などを周知し、適正な運用に努めていきたい」としています。
