フランスで来月からの施行に向けて準備が進められてきた15歳未満の子どものSNSの利用を禁止する法律について、フランスの憲法評議会は14日、表現の自由の侵害にあたるなどとして違憲とする判断を示しました。

フランスでは先月、子どものSNSの利用を禁止する法案が可決され、15歳未満の子どもは来月からSNSのアカウントが新たに作れなくなり、既存のアカウントも来年から使えなくなるとしていました。

この法律の合憲性について、野党議員の申し立てを受けて審査した憲法評議会は14日、違憲とする判断を示しました。

理由として機能やコンテンツを絞らず全面的に禁止していることなどを挙げ、「表現や通信の自由を不相応に侵害する」としています。

さらに、大人を含むすべての利用者に年齢確認を求めているものの詳しい条件を定めておらず、プライバシーの保護が不十分だとしています。

違憲の判断を受けてフランス大統領府は声明で、マクロン大統領が改めて法案を作成するよう首相に指示したと明らかにした上で、「改革を実現するという決意は揺らいでいない」と強調しています。

子どものSNS利用の規制は去年オーストラリアが開始し、EU＝ヨーロッパ連合やイギリスでも導入に向けた動きが広がっていて、今回の違憲判断が議論に影響を与えるかが注目されます。
