営業秘密持ち出し 楽天モバイルへの賠償請求認めず 東京地裁

携帯電話の通信規格に関する営業秘密を転職した元社員に不正に持ち出されたとして、ソフトバンクが楽天モバイルに賠償を求めた裁判で、東京地方裁判所は訴えを退ける判決を言い渡しました。

ソフトバンクは、6年前に楽天モバイルに転職した元社員に高速・大容量の通信規格5Gに関する営業秘密を不正に持ち出されたとして、営業秘密を使用しないことや10億円の賠償などを求めました。

裁判で楽天モバイルは「IDやパスワードによってアクセス制限されていなかったファイルで、秘密に管理する情報だと明示されていなかった」などと争いました。

元社員はファイルを不正に持ち出したとして、不正競争防止法違反の罪に問われ、4年前に東京地裁で有罪判決を受けています。
