ことし2月の衆議院選挙でいわゆる1票の格差が最大で2.1倍だったことについて、大阪高等裁判所は憲法に違反しないと判断し、選挙の無効を求める訴えを退けました。

ことし2月の衆議院選挙では選挙区によって議員1人当たりの有権者の数に最大で2.1倍の格差があり、2つの弁護士のグループは「投票価値の平等に反し、憲法に違反する」として、選挙の無効を求める訴えを全国の高等裁判所や支部にあわせて16件起こしています。

このうち、関西2府4県の小選挙区を対象にした裁判の判決で、大阪高等裁判所の森崎英二裁判長は、憲法に違反しないと判断して訴えを退けました。

衆議院選挙の1票の格差をめぐっては、前回 2024年の選挙で、より人口に比例した議席の配分方法とされる「アダムズ方式」が初めて適用された結果、1票の格差は最大で2.06倍となり、最高裁判所は、去年、憲法に違反しないと判断しました。
