ユーザーをだまして損害を与えるデザインやインターフェース「ダークパターン」とは
消費者庁は4月、「いわゆる『ダークパターン』に関する取引の実態調査」を発表した。
「ダークパターン」は、公的機関によって「ユーザーを欺いたり操作して、それがなければ選択しなかったであろう選択をさせ、害を及ぼす可能性があるデザインの慣行」等と整理されているもので、法令の中では「ユーザーの自主性、意思決定又は選択を妨害し又は損なう実質的な効果を有するよう設計され又は操作されたインターフェイス」と定義付けるものがある。
同調査では、研究者による概念の整理や公的機関による整理等を概観し、ダークパターンとして念頭に置かれている事例が幅広く、是非の判断が分かれること等から、必ずしも統一的な概念ないし意義として把握されているわけではないが、「1. 消費者の誤解を招いたり誘導することを通じて意図しないことをさせる」か、消費者の自主的な意思決定や選択を損なうことによって、「2. 消費者の最善の利益に反するとともに事業者の利益になる意思決定をさせる」といった要素が見られるとまとめている。
ダークパターンの想定される事例として、下記を紹介している。
・EU
EUでは、ダークパターンに関連する法執行又は運用として、アマゾン社のプライム会員の退会時、アプリでは合計9回のタップが必要であるとともに各画面で真意の確認や翻意を促す表示がされていることについて、欧州委員会の指摘で合計2回のタップで退会することができるようシステムを設計するとの合意がアマゾン社との間に成立したとされる。
一般データ保護規則（GDPR:General Data Protection Regulation,Regulation2016/679/EU）の執行事例として、フランスのデータ保護機関（情報処理と自由に関する国家委員会、CNIL）では、通信機器小売販売会社が、個人情報を第三者に提供することに同意するボタンが特に強調され、同意をせずにサービスを利用することができるハイパーテキストリンク（「ここをクリック」）が、ボタンよりはるかに小さい文字で特に強調せずに表示されるといった画面上の表示に関し、GDPRで規定されている個人の明確な同意を得る義務が遵守されていない等の理由で、525,000ユーロの罰金を科したものがある。
