政治系切り抜き動画 求人仲介サイトで編集依頼の禁止 相次ぐ
政治家の発言などを編集してYouTubeなどに投稿する「政治系切り抜き動画」について、求人仲介サイトが動画編集の仕事の依頼を禁止する動きが出てきています。
金銭が支払われることが公職選挙法に違反するリスクがあるという指摘もあり、大手の会社の1つは「法令に抵触する可能性があるため」などとしています。
「政治系切り抜き動画」は去年の東京都知事選挙や兵庫県知事選挙で注目が集まり、政治への関心を高める一方、ひぼう中傷や誤った情報が広がる要因にもなっていると指摘されています。
動画は再生回数の多いものも多く、広告収入を得られることもあって、求人仲介サイトを通じて編集などを依頼するケースが見られていました。
こうした動画の編集などの求人について、大手サイトの1つ「クラウドワークス」は先月ガイドラインを改訂し「選挙活動」に関する仕事に加え「政治活動などに関わる内容が含まれる依頼」も禁止としました。
クラウドワークスは「発注者と受注者が法令に抵触する可能性があるため」などとしています。
会社のサイトには政治系切り抜き動画の編集などの求人が、ことし2月の時点で600件余り掲載されていましたが、すでに見られなくなっています。
ほかのサイトでも「ココナラ」は「特定の政治家や政党に対する内容と判断される動画制作サービス」について依頼はできないとし、公職選挙法に違反するおそれのある行為を確認した場合は専門チームで取り下げや警告などを行うとしているほか「ランサーズ」もガイドラインで「選挙活動などに関わる内容」の依頼を禁止しています。
公選法違反のリスク 法律の解釈 国が明示を
公職選挙法に詳しい一橋大学の只野雅人教授は「お金を渡して切り抜き動画の制作という形で主体的、裁量的に選挙運動をさせているとみなされた場合は買収にあたり、公職選挙法違反のリスクがある」としたうえで「判断が難しいため、全般的に依頼を掲載しない動きになっているのだろうと思う。想定していなかった事例なので、法律の解釈を国が明示する必要がある」と話しています。
