交際相手の1歳の息子に暴行を加えた罪に問われた男性の裁判で、大阪地方裁判所は、捜査段階で作成された自白調書の信用性を認めず男性に無罪を言い渡しました。
おととし10月、大阪市内のマンションで、交際相手の1歳の息子に暴行を加えて死なせたとして傷害致死の罪で起訴され、検察はその後、腹の辺りを手で押して突き飛ばしたとする暴行の罪に変更しました。
捜査段階で自白調書が作成されましたが、長谷川さんはその内容を否定し裁判は調書の信用性が争われました。
13日の判決で大阪地方裁判所の大森直子裁判長は「警察官の取り調べは二人きりで行われ、録音や録画もされず、やりとりを客観的に確認できないことも踏まえると、警察官の求める内容にゆがめられるなどした可能性を否定しがたい」と指摘しました。
そのうえで「自白調書は核心部分を裏付ける証拠などがなく、信用性に疑問が残る」として無罪を言い渡しました。
無罪判決について大阪地方検察庁の上野正晴次席検事は「判決内容を精査し、適切に検討したい」とコメントしています。
