大川原化工機 えん罪事件 捜査の違法性認めた判決確定 検証は
横浜市の「大川原化工機」をめぐるえん罪事件で、違法な捜査をしたとして東京高等裁判所に賠償を命じられた都と国は、11日までに上告せず、警視庁公安部と検察の捜査の違法性を認めた判決が確定しました。今後行われる検証で、えん罪を生んだ経緯がどこまで明らかになり、再発防止につなげられるかが焦点となります。
軍事転用が可能な機械を不正に輸出した疑いで逮捕、起訴され、後に無実が判明した、横浜市の化学機械メーカー「大川原化工機」の社長などが都と国を訴えた裁判で、2審の東京高等裁判所は先月、1審に続いて警視庁公安部と東京地検の捜査の違法性を認めるとともに「輸出規制の要件についての警視庁公安部の解釈は国際的な合意と異なり、合理性を欠いていた」などと指摘し、都と国にあわせて1億6600万円余りの賠償を命じました。
都側の警視庁と国側の東京地方検察庁は11日、会社の関係者に今後直接謝罪することや、最高裁判所に上告しないことを決め、判決が確定しました。
警視庁は副総監をトップとする「検証チーム」を立ち上げたほか、最高検察庁は次長検事を責任者とする態勢で検証を進める方針を明らかにしました。
えん罪を生んだ経緯がどこまで明らかになり、再発防止につなげられるかが焦点となります。
