生活保護引き下げは違法 名古屋高裁金沢支部 最高裁と同様判断
生活保護の支給額の段階的な引き下げについて最高裁判所がことし6月に違法だとする判断を示したあと、各地で続いている裁判としては初めての判決が名古屋高等裁判所金沢支部で言い渡され、最高裁と同様、違法だとして処分を取り消しました。
生活保護の支給額を国が物価の下落を反映するなどとして2013年から段階的に引き下げたことについて、「健康で文化的な最低限度の生活を守るという法律に違反している」などとして取り消しと賠償を求める裁判が各地で起き、およそ30件にのぼっています。
このうち名古屋と大阪の裁判について、最高裁判所は、ことし6月「厚生労働大臣の判断に誤りがあり、違法だった」として処分を取り消す判決を言い渡しましたが、その後もほかの裁判は続いています。
17日は、石川県と富山県の受給者が訴えていた裁判の2審の判決が言い渡されました。
判決で、名古屋高等裁判所金沢支部の大野和明裁判長は、物価の下落の調整に関して「専門的な知見との整合性を欠くところがある。厚生労働大臣の判断の過程や手続きには過誤、欠落があり違法というべきだ」として最高裁と同様、引き下げの処分を取り消しました。
国に賠償を求める訴えは退けました。
弁護団によりますと、最高裁の判断のあとの裁判としては初めての判決で、1審の金沢地裁と富山地裁では違法かどうかの判断が分かれていましたが、最高裁と同様の判断が示されました。
最高裁の判決を受けて、支給額を引き下げた分をさかのぼって支給するかどうか、国の対応が焦点となっていて、厚生労働省が専門家による委員会を設置して議論しています。
