ハーレー日本法人 独禁法違反で課徴金へ 販売店に過剰ノルマか
オートバイの老舗ブランド「ハーレーダビッドソン」の日本法人が、販売店に対して自分たちで新車を購入しないと達成できない過剰なノルマを一方的に決め、独占禁止法に違反したとして、公正取引委員会がおよそ2億円の課徴金を納付する命令を出す方針を固めたことが関係者への取材でわかりました。
課徴金の納付命令を受けるのはアメリカのオートバイメーカー「ハーレーダビッドソン」の日本法人で、東京 新宿区の「ハーレーダビッドソンジャパン」です。
関係者によりますと遅くともおととし1月以降、国内の数十社の販売店に対し、自分たちで新車を購入しなければ達成できないほどの過剰なノルマを一方的に決めたうえで、ノルマ達成が一定の割合に満たなかった場合、正規の販売店としての契約を更新しないことを示唆するなどしていたということです。
中には自腹の形で新車を購入させられて経営が圧迫され、廃業した販売店もあるということです。
公正取引委員会は去年7月、立ち入り検査を行って調査を進め独占禁止法が禁じる「優越的地位の乱用」に当たるとして、ハーレーダビッドソンジャパンにおよそ2億円の課徴金の納付命令と再発防止などを求める排除措置命令を出す方針を固め、会社側に通知したということです。
公正取引委員会は今後、会社側の意見を聴き取ったうえで、正式に処分を決めるものとみられます。
