「法定養育費」月額2万円とする省令案まとめる 法務省
民法改正に伴い、養育費の取り決めをせず離婚した場合に、一定額を請求できる「法定養育費」について、法務省は月額2万円とする省令案をまとめました。
離婚後のいわゆる「共同親権」を導入するため、改正された民法などには、事前の取り決めをせず離婚した場合に一定額を請求できる「法定養育費」の制度を設けることが明記されていて、来年5月までに施行されることになっています。
これを前に、法務省は「法定養育費」を子ども1人当たり月額2万円とすることなどを柱とする省令案をまとめました。
それによりますと「法定養育費」について、子どもの最低限度の生活を維持するのに必要な標準的な費用の額として、子ども1人当たり月額2万円としています。
また、養育費の支払いが滞った場合は財産を差し押さえて、子ども1人当たり月額8万円までを上限として、優先的に弁済を受けることができるとしています。
養育費は、親の経済状況などによって異なることから、法務省は、「法定養育費」はあくまで暫定的な措置として周知を図りたいとしています。
法務省は今後、こうした省令案のパブリックコメントを行った上で、必要な改正を行う方針です。
