文化庁 「指定宗教法人」解散後の清算手続きの指針案まとめる
旧統一教会の被害者救済を見据えて、文化庁は、「指定宗教法人」の解散後に清算手続きを進めるための指針案をまとめました。すぐに被害の申し出ができない人を想定し、救済期間を長期間、設定する必要があるとしています。
「指定宗教法人」には、現在、旧統一教会だけが指定されていて、文化庁は、「指定宗教法人」の解散後の財産の清算手続きについて検討してきました。
3日に示された指針案によりますと、すぐに被害の申し出ができない人が想定されるとして、確実に被害が回復されるよう、
▽救済期間を長期間、設定することや
▽宗教法人側に代わって弁償を行う財団を設立すること
などが必要だとしています。
また、
▽相談窓口の設置や説明会の開催
▽清算人への妨害には、刑事、民事上で責任を追及することも検討するとしています。
一方で、信教の自由に対する配慮として、清算に支障のない範囲で、信者に施設の使用を認めたり、宗教活動に利用されていない不動産から処分したりすることが明記されています。
文部科学省は、今回の指針案について、早ければ今週中にもパブリックコメントを実施したうえで、10月に指針を策定したいとしています。
