大塚製薬の男性社員の自殺は労災と認める判決 東京地裁
2018年、大塚製薬の当時31歳の男性社員が自殺したことをめぐり、遺族が労災と認めるよう国を訴えた裁判で、東京地方裁判所は「業務の繁忙により肉体的・精神的疲労が蓄積していた」などとして、訴えを認める判決を言い渡しました。
8年前、大塚製薬の当時31歳の男性社員が、長崎市の出張所に営業課の係員として配属されていた際、精神疾患を発症して自殺し、遺族は「長時間労働などが原因だ」として、労災と認めるよう求めましたが、長崎労働基準監督署に認められず、遺族補償などが支給されませんでした。
15日の判決で、東京地方裁判所の須賀康太郎裁判長は、精神疾患を発症する6か月前から5か月前にかけての時間外労働が月80時間を超え、2週間以上の連続勤務も行っていたとして、「業務の繁忙により肉体的・精神的疲労が蓄積していた」と指摘しました。
そのうえで、「異動による人員削減をきっかけに一層の負荷がかかる状態が継続し、男性は強い心理的負荷を受けた」と判断して、自殺は業務が原因だとして労災と認め、国の処分は違法だとして取り消しました。
